SECTION IX — SECURITY (ENFORCEMENT, INTERPRETATION & AMENDMENTS)
1. Chain of Authority
– Proprietor (final legal authority): Elliot KAB Yamoah.
– IAPD National (Administrative & Audit Authority): empowered to enforce, interpret, audit, approve departmental procedures, and apply sanctions. IAPD National issues interpretive guidance; in the absence of Proprietor direction, reasonable IAPD National interpretation governs temporarily until ratified.
2. Enforcement
– IAPD National, acting under Proprietor authority, will investigate violations and apply sanctions consistent with these Bylaws. Sanctions may include remediation, suspension, financial recovery, and termination.
3. Amendments & Ratification
– Bylaws will be reviewed at least annually. Proposals may be made by the Proprietor, IAPD National, or departments.
– Material amendments require:
– Publication of proposed amendment and a minimum 30-day public comment period in the Bylaws forum on buzzjuice.net (or successor platform) and notice on koware.org.
– IAPD National review and recommendation.
– Proprietor ratification (or delegated ratification in writing).
– Version history is maintained at koware.org/bylaws.
4. Dispute Resolution & Governing Law
– Governing law: Ghanaian law. Parties may pursue mediation or arbitration; where court action is necessary, Ghanaian courts have primary jurisdiction. Cross-border disputes may consider applicable international treaty obligations.
5. Severability
– If any provision is invalid or unenforceable, the remainder of the Bylaws remains in effect.
